ONLINE STORE TERMS

All of our products are collectibles that are traditionally and solely intended for tobacco use or concentrated essential oils, by legal adults. You must be 18 years old (21 in some areas) to purchase anything from this website. All products on this website are intended for legal use and may not be used, or discussed in a manner that is illegal.  As a consumer, it is your sole responsibility to know your state and local laws regarding the possession and use of tobacco pipes and accessories.  By entering this site, you acknowledge and agree that PRETTYHIGH, LLC has not reviewed all the sites linked to this site and is not responsible for the content of any off-site pages or any other site linked to this site. Although this site may be linked to other sites, PRETTYHIGH, LLC is not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with the linked site, unless specifically stated. Your linking to any other off-site pages or other sites is at your own risk.

You may not use products sold on this site for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

PRETTYHIGH, LLC or its owners, operators, and staff will NOT be held liable for any illegal activity, legal recourse, or lawyer's fees resulting from the purchase and/or use of any of our products. Our site is for informational use. Also, any governmental employee, agency, or agent must identify themselves to the operators of PRETTYHIGH, LLC upon their entering the site, and when ordering any products from our site. 

US Code 21-863 refers to ALL materials used to manufacture tobacco accessories; metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes. In specific, pipes with carburetion devices (third holes) are considered to be paraphernalia regardless of the material used to manufacture the pipe. Traditional tobacco accessories like pipes, cigar and cigarette holders and hookah/sisha pipes are not included in the list of Contemporary accessories. U.S. vs. Posters & Things (Supreme Court - 1996) upholds this code as the OBJECTIVE standard by which paraphernalia is judged. Further, it describes other relevant factors in this determination to include whether the owner is a licensed distributor or retailer of tobacco products. Ten states have adopted USC 21-863 as state law, three more are in the process of adoption. All other states have either less rigorous SUBJECTIVE (intent) statutes or no law on this subject at all! All of our glass pipes conform to RTDA guidelines for bowl depth and width. By entering this site, you acknowledge and agree that this site will only be construed and evaluated according to Texas law. If you use this site from other locations, you are responsible for compliance with any and all applicable local laws. PRETTYHIGH, LLC makes no representations that the materials contained within this site are appropriate for locations outside Texas. Any and all information contained in this site, including but not limited to information related to products and services, applies only to those provided or offered in Texas. PRETTYHIGH, LLC reserves the right to refuse service/goods.

LIMITATION OF LIABILITY

PRETTYHIGH, LLC shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if PRETTYHIGH, LLC has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
 

TYPOGRAPHICAL ERRORS

In the event that a PRETTYHIGH, LLC product is mistakenly listed at an incorrect price, PRETTYHIGH, LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. PRETTYHIGH, LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, PRETTYHIGH, LLC shall issue a credit to your credit card account in the amount of the incorrect price.
 

TERM; TERMINATION

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by PRETTYHIGH, LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of PRETTYHIGH, LLC products) shall be in the state or federal courts located in Austin, Texas

Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of PRETTYHIGH, LLC products) must be commenced within one (1) year after the claim or cause of action arises.

PRETTYHIGH, LLC's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. PRETTYHIGH, LLC may assign its rights and duties under these Terms of Service to any party at any time without notice to you.
 

INDEMNIFICATION

You agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS PRETTYHIGH, LLC, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
